Russell Beck and Hannah Joseph will be speaking at the first ever Boston Bar Association Trade Secrets and Restrictive Covenants Conference. The online conference will take place on June 9, 2021, from 9:00 a.m. to 2:15 p.m. ET.

The conference was first suggested by Russell, who also helped organize the event. Russell will be moderating and speaking on the panel titled, “The Implications of the Massachusetts Noncompetition Agreement Act and Other State and Federal Legislative Developments.”

Hannah will be speaking on a panel titled, “Trade Secret Protection Programs: What Companies and their Advisors Need to Know Now.”

Other sessions will include a multi-side role-play perspective on risk mitigation during a key employee departure.

The conference will feature more than one dozen speakers and moderators, including several judges from Massachusetts federal and state courts.

Russell Beck has been elected President-Elect of the Boston Bar Foundation.

The Boston Bar Foundation’s 2019-2020 leadership team includes President Diana Lloyd of Choate Hall & Stewart, LLP, Treasurer Stephen P. Hall, of Holland & Knight, LLP, and Secretary Suma V. Nair of Goulston & Storrs PC.

Founded in 1957, the BBF is the charitable affiliate of the Boston Bar Association with a mission to promote justice by funding and promoting innovation in legal services, enhancing access to justice for the underserved, and supporting the public interest activities of the bar.

The Trustees oversee the support of the many programs the BBF funds throughout the year. Stephen Riden Moderates Discussion with Judge Young on Arbitration

On May 29, 2019, Steve Riden hosted a discussion with The Honorable William G. Young, Judge, U. S. District Court, District of Massachusetts, at the Boston Bar Association on the topic of arbitration. 

The presentation was titled “Reconsidering Arbitration: A Conversation with Judge Young.”

The focus of the presentation was a December 2018 decision by U.S. District Court Judge William G. Young concerning the use of arbitration clauses in commercial transactions. The decision was entered in the case titled CellInfo, LLC v. American Tower Corporation, 18-cv-11250, United States District Court, District of Massachsuetts.

The presentation featured discussion about the line between myth and reality concerning the value of arbitration.

In the CellInfo decision, Judge Young conducted a lengthy analysis of private arbitration, titled “Whatever Were They Thinking? Myths and Realities Concerning Courts and Arbitration.”

The court introduced its analysis of arbitration as follows: “How could an otherwise sophisticated agreement have made such a hash out of the parties’ intentions concerning the interplay of arbitration and court processes? It appears that in this ‘big law’ era, the drafters operated under the myth that arbitration is cheaper, faster, and more confidential than litigation (only one of these is true) without talking to trial lawyers who understand the reality that while people may not want trials, what they do want is a firm and reasonably prompt trial date before an impartial fact-finder as the best chance for a fairly negotiated settlement.” Judge Young’s analysis proceeded with in-depth discussion of the pros and cons of arbitration, and comparisons to court proceedings.

Boston commercial litigator Stephen D. Riden says Young made some very good points in CellInfo, points that he himself has raised with his corporate clients.

“In dealing with companies, there’s a perception that arbitration is always going to be faster, cheaper and more confidential than a federal court proceeding,” Riden says. “That’s not always right.”

Stephen Riden Named Co-Chair of Boston Bar Association’s Litigation Section

Steve Riden has been named co-chair of the the Boston Bar Association’s Business and Commercial Litigation Section for 2017 & 2018.

This section of the Boston Bar Association is responsible for organizing presentations on topics relevant to commercial litigators. Among other events, the section is responsible for organizing the annual Business Litigation Session Year in Review, which features a panel of all current judges in the Commonwealth’s Business Litigation Session. Russell Beck Speaks at Noncompete and Trade Secrets Symposium

On June 13, 2017, Russell Beck was a panelist at the 9th Annual Symposium on Non-Compete Agreements and Trade Secrets in Boston, Massachusetts.

The Symposium featured discussion and debate about the legal landscape of noncompete agreements and the protection of trade secrets.

The Boston Bar Association describes the event as follows:

Since 2009 BBA has hosted this symposium bringing together drafters, sponsors, supporters and critics of state bills to reform the use of employee non-compete agreements (ENCAs) and, separately, alternatively or complementarily, to enact the Uniform Trade Secrets Act (UTSA).

In the second session of the 189th General Court, its two chambers passed differing bills for ENCA reform, each including a version of UTSA, but did not quite get over the finish line. Current bills S.840, S.988, S.1017, S.1020, H.854, H.2366, and H.2371 revisit ENCA reform and propose a version of UTSA enhanced by the BBA over the years.

The federal Defend Trade Secrets Act of 2016 (“DTSA”) among other things embraced “employee mobility” as a federal policy.  DTSA injunctions may not “prevent a person from entering into an employment relationship . . . or otherwise conflict with an applicable State [such as California] law prohibiting restraints on the practice of a lawful profession, trade, or business.”  While DTSA expressly does not preempt state trade secret law, it is silent about contract law, which arguably may be affected by these prohibitions.
